Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Translatium ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. License Grant

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App on devices you own or control, in accordance with your license tier.

License Restrictions

  • You may not redistribute, sell, or sublicense the App
  • You may not reverse engineer, decompile, or disassemble the App
  • You may not use the App for any unlawful purpose
  • You may not circumvent any usage limits or license restrictions

3. Translation Engines

3.1 Translatium AI

Limited to 1,000 tokens per day and 30,000 tokens per month. Usage resets at midnight UTC daily and on the first day of each month.

Note: Translatium AI uses OpenAI's GPT-4.1-mini model. By using this engine, you acknowledge that your translation requests are processed by OpenAI and are subject to OpenAI's Terms of Use and Privacy Policy.

3.2 Translatium Engine

Unlimited translations using our proprietary translation engine. Available with a valid license.

3.3 OpenAI Integration

Requires your own OpenAI API key. You are responsible for any charges from OpenAI. Your API key is stored locally and subject to OpenAI's terms of service.

Security: Your OpenAI API key is stored exclusively on your local device and is never transmitted to Translatium servers. We have no access to your API key or usage data when using this engine.

4. Data Storage Commitment

Translatium does NOT store on our servers:

  • Your OpenAI API key (stored locally on your device only)
  • Translation content or history
  • Text you select or copy
  • Any personal documents or data you translate

We only store license information and anonymized usage metrics (token counts) necessary for quota management.

5. License Key and Activation

A valid license key is required to use the App. Each license key has a maximum number of device activations based on your plan.

  • License keys are non-transferable
  • Sharing license keys is prohibited
  • We reserve the right to revoke licenses that violate these Terms
  • License revocation is communicated in real-time via the App

6. System Requirements

  • macOS 14 (Sonoma) or later
  • Apple Silicon or Intel processor (Universal Binary)
  • Accessibility permission (for selection-based translation)
  • Internet connection (for translation services)

7. Acceptable Use

You agree not to use the App to:

  • Translate content that violates any laws or regulations
  • Process content that infringes on intellectual property rights
  • Attempt to bypass usage limits or security measures
  • Use automated systems to abuse the translation service
  • Translate content that is harmful, abusive, or discriminatory

8. Intellectual Property

The App, including its design, code, and features, is owned by Translatium and protected by copyright and other intellectual property laws. Your license does not grant you any ownership rights to the App.

9. Updates and Modifications

We may update the App periodically via the Sparkle framework. Updates may include bug fixes, new features, or security patches. Continued use of the App after updates constitutes acceptance of any modified terms.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Merchantability and fitness for a particular purpose
  • Accuracy or reliability of translations
  • Uninterrupted or error-free operation
  • Compatibility with all applications or systems

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRANSLATIUM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE APP.

12. Termination

We may terminate or suspend your license immediately, without prior notice, if you breach these Terms. Upon termination:

  • Your right to use the App ceases immediately
  • You must uninstall the App from all devices
  • No refunds will be provided for unused license periods

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Translatium operates, without regard to its conflict of law provisions.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes through the App or via email. Continued use of the App after changes constitutes acceptance of the new Terms.
